Access to administrative documents is a general principle of administrative activity in order to foster participation and ensure impartiality and transparency.
The law guarantees the right of access to public administration documents, data and information. Different rights of access are provided, with different modalities and requirements depending on the type of information sought and the reasons for the request.
Access to records
Access to records (Art. 22 of Law No. 241/1990) recognizes the right to view and extract copies of administrative documents to all private parties, including those with public or diffuse interests, who have a direct, concrete and current interest, corresponding to a legally protected situation and related to the document to which access is requested.
A request for access to records must be substantiated and submitted to the administration that formed the document or holds it permanently.
Simple Civic Access
Simple civic access (Art. 5 co.1 of Legislative Decree No. 33/2013) grants anyone the right to request documents, information or data that are subject to mandatory publication under current regulations and that the administration has failed to publish.
The request for simple civic access must be submitted to the Ministry of Culture's Head of Corruption Prevention and Transparency.
Generalized Civic Access
Generalized civic access (Art. 5 co.2 of Legislative Decree No. 33/2013) grants anyone the right to request documents, information or data in addition to those subject to mandatory publication pursuant to current legislation, in compliance with the limits related to the protection of legally relevant interests, in order to encourage widespread forms of control over the pursuit of institutional functions and the use of public resources and to promote participation in public debate.
