Granting of space – Request for images and authorization for reproduction


Legislative Decree 33/2013 – Article 35, paragraphs 1 and 2– Publication requirements relating to administrative procedures and checks on substitute declarations and the automatic acquisition of data
1. Public administrations shall publish data relating to the types of procedures within their competence. The following information shall be published for each type of procedure:
a) a brief description of the procedure with an indication of all relevant regulatory references;
b) the organizational unit responsible for the preliminary investigation;
c) the name of the person responsible for the procedure, together with their telephone number and institutional email address, as well as, where different, the office responsible for adopting the final measure, indicating the name of the person responsible for the office, together with their telephone number and institutional email address;
d) for proceedings initiated by a party, the documents to be attached to the application and the necessary forms, including facsimiles for self-certifications, even if the submission of such documents accompanying the application is required by law, regulations, or acts published in the Official Gazette, as well as the offices to contact for information, the opening hours and methods of access, with an indication of the addresses, telephone numbers, and institutional email addresses to which applications should be sent;
e) the methods by which interested parties can obtain information on ongoing proceedings concerning them;
f ) the deadline set in the regulatory framework of the procedure for its conclusion with the adoption of an express measure and any other relevant procedural deadlines;
g) the procedures for which the administrative measure may be replaced by a declaration by the interested party, or the procedure may be concluded with the tacit consent of the administration;
h) the administrative and judicial protection measures recognized by law in favor of the interested party, during the procedure and with regard to the final measure or in cases where the measure is adopted after the predetermined deadline for its conclusion, and the methods for activating them;
i) the link to access the online service, if already available on the internet, or the expected time frame for its activation;
l) the methods for making any necessary payments, with the information referred to in Article 36;
m) the name of the person to whom, in the event of inaction, the power of substitution is attributed, as well as the methods for activating this power, with an indication of telephone numbers and institutional email addresses;
n) the results of customer satisfaction surveys conducted on the quality of services provided through various channels, highlighting the relevant trends.
2. Public administrations may not require the use of forms and templates that have not been published; in the event of failure to publish, the relevant procedures may be initiated even in the absence of the aforementioned forms or templates. The administration may not reject the application on the grounds of failure to use the forms or failure to produce such documents, and must invite the applicant to supplement the documentation within a reasonable time.
